Overview

Arbitration advocacy is equal parts science and art with one goal: persuasive story telling. Persuasive story telling convinces the listener, in this case an arbitrator, to see the advocate’s point of view while at the same time addressing an alternate point of view- that of your opponent. At arbitration, this story telling is governed by a set of rules that dictate how the story can be told.

The Arbitration Advocacy Certificate program helps participants learn and practice these technical aspects of the advocacy process and develop their skills to clearly and effectively present their story before a labor arbitrator. In Part 1 of the certificate, the focus is on case analysis, preparation of opening statements, direct examination of witnesses and presenting evidence. In Part II, participants gain hands-on experience in the skills of cross examination through practice and expert coaching

Both non-attorneys and attorneys are welcome to take the classes.

Participants have the option to add to their certificate by preparing and presenting a brief case before an arbitrator and receiving feed back either in person or virtually for an additional $250. Cases will be scheduled based on the arbitrators’ availability.

From the perspective of both the union and management, participants will practice how to develop a clear and effective theory of the case, create a proposed issue statement, identify and examine witnesses and present evidence.

Arbitration Advocacy: Part II - Cross-Examination

Cross examination is one of the most important but often poorly used parts of an advocate’s case.  Participants learn and practice the skills required to prepare and execute an effective cross, while identifying commonly made errors.  Participants practice cross-examination and receive coaching and feedback from experienced advocates and arbitrators.
